Generally yes, when properly drafted — most states enforce fitness facility waivers that are clear, conspicuous, and signed voluntarily. A few states (e.g. Louisiana, Virginia) limit or refuse enforcement, so attorney review for your state is essential.

Do existing members need to re-sign?

Best practice is to collect a fresh signature whenever your waiver text changes materially, and re-confirm annually. With digital waivers, re-signing is a link in an email rather than a front-desk traffic jam.
